1. Definitions
For the purposes of these regulations, the following meanings are assumed for the terms below:
- Buyer– a natural person, legal entity, or an organizational unit without legal personality,
- Consumer– a natural person entering into a sales agreement with the Seller not directly related to their business or professional activity,
- Regulations– these regulations, available at the addresshttps://artantonio/regulamin,
- Store– online store operating at the addresshttps://artantonio.com,
- Seller– Andrzej Ochojski, conducting business under the name "Andrzej Ochojski Publishing ROZMOWY", ul. Gliwicka 3/3, 44-200 Rybnik, NIP: 6451751415.
2. Preliminary provisions
- Through the Store, the Seller conducts retail sales while simultaneously providing services to Buyers electronically. Through the Store, the Buyer can purchase products displayed on the Store's pages.
- The regulations define the rules and conditions for using the Store, as well as the rights and obligations of the Seller and Buyers.
- To use the Store, particularly to make a purchase, there are no special technical conditions required for the Buyer’s computer or other device. The following are sufficient:
- access to the Internet,
- a standard operating system,
- a standard web browser,
- having an active email address.
- The Buyer cannot make a purchase in the Store anonymously or under a pseudonym.
- It is prohibited to provide unlawful content while using the Store, particularly by sending such content through forms available in the Store.
- All product prices listed on the Store's pages are gross prices.
3. Services provided electronically
- Through the Store, the Seller provides services electronically to the Buyer.
- The primary service provided electronically to the Buyer by the Seller is to enable the Buyer to place an order in the Store. Placing an order is possible without the need to create an account in the Store.
- If the Buyer decides to create an account in the Store, the Seller also provides the Buyer with an electronic service consisting of creating and maintaining an account in the Store. The account stores the Buyer’s data and the history of orders placed by them in the Store. The Buyer logs into the Account using their email address and a password defined by them.
- Creating an account in the Store is done by filling out and submitting, via the Store's automated mechanism, a registration form. Upon submitting the registration form, a contract for maintaining an account in the Store is concluded between the Buyer and the Seller. The contract is concluded for an indefinite period, and the Buyer can terminate this contract with immediate effect at any time by deleting their account.
- Services provided electronically to the Buyer are free of charge. However, the sales agreements concluded through the Store are chargeable.
- To ensure the security of the Buyer and data transmission in connection with using the Store, the Seller takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, particularly measures aimed at preventing unauthorized access to and modification of personal data.
- The Seller takes action to ensure the fully correct functioning of the Store. The Buyer should inform the Seller of any irregularities or interruptions in the functioning of the Store.
- All complaints related to the functioning of the Store can be reported by the Buyer via email to the address:biuro@artantonio.com.In the complaint, the Buyer should provide their first and last name, correspondence address, as well as the type and date of the irregularity related to the operation of the Store. The Seller will consider all complaints within 14 days of receiving the complaint and will inform the Buyer of its resolution at the email address provided by the complainant.
4. Placing an Order
- The Buyer can place an order as a registered customer or as a guest.
- A registered customer is a Buyer who has an account in the Store. The Buyer can create an account from the tabhttps://artantonio.com/my-account/or during the order placement process.
- To place an order, the Buyer is required to take the following steps:
- select the product or products being ordered by clicking the "Add to Cart" button,
- follow the instructions displayed on the screen, leading to the confirmation of the order.
- In the order form, the Buyer must provide true personal data. The Buyer is responsible for providing false personal data. The Seller reserves the right to suspend the order fulfillment if the Buyer has provided false information or if such information raises reasonable doubts for the Seller regarding its accuracy. In such a case, the Buyer will be informed by phone or via email about the Seller's doubts. In this situation, the Buyer has the right to clarify any circumstances related to the verification of the truthfulness of the provided data. If there is a lack of data allowing the Seller to contact the Buyer, the Seller will provide all explanations after the Buyer makes contact.
- The Buyer declares that all data provided by them in the order form is true, while the Seller is not obliged to verify its truthfulness and accuracy, although they have such authority according to paragraph 4 above.
- If the Buyer has chosen the method of payment for orders in the form of a bank transfer, after clicking the "I Buy and Pay" button, they will be immediately redirected to the order confirmation page. From that moment, the sales contract for the products covered by the order is considered concluded between the Buyer and the Seller.
- If the Buyer wishes to order a product not included in the Store's offer, requiring special execution, they must place such an order in the form of an email to the address:biuro@artantonio.com. In such a case, the Seller presents the Buyer with a special offer, specifying the price, delivery conditions, and execution time. Confirmation of acceptance of this offer by the Buyer constitutes the conclusion of the contract and initiates the execution and delivery mode of the product. The Buyer may withdraw from this contract without financial consequences before the product is shipped.
5. Delivery Methods and Payment Methods
- Order deliveries are carried out through shipments via companies:
- Polska Post Digital Services Ltd. – a company from the Polish Post Group operating under the Envelo brand.
- Inpost Ltd. based in Krakow.
- The delivery cost is 15 PLN for each shipment weighing up to 3 kg.
- The cost of delivery is borne by the Buyer unless the Seller specifies otherwise in the Store.
- The entity providing online payment services for order payment is Autopay S.A.
- The Buyer has the following payment methods available for ordered products:
- transfer from their own account to the Seller's bank account,
- use of the online payment methods available in the Store, supported by Autopay S.A. Available payment forms:
- Payment cards: * Visa, * Visa Electron, * Mastercard, * MasterCard Electronic, * Maestro.
6. Order Fulfillment
- After the Buyer places an order in accordance with the procedure described in § 4 of the Regulations, a confirmation of the order will be sent to the Buyer's email address.
- If the Buyer has chosen the payment method in the form of a transfer to the Seller's bank account, they are required to pay for the order within 3 days from the moment the contract is concluded. After 14 days of waiting for payment without success, the order may be canceled.
- Order fulfillment consists of sending it to the Buyer.
- The order fulfillment time is a maximum of 3 business days. The order is considered fulfilled at the moment the ordered goods are dispatched for shipping.
- The order fulfillment time is counted from the moment payment for the order is received.
- After fulfilling the order, the Seller will send a confirmation of order fulfillment to the Buyer's email address containing the tracking number and a link to track its journey.
7. Withdrawal from the Consumer Agreement
- A consumer who has entered into a distance contract with the Seller has the right to withdraw from the contract without giving any reason:
- by refusing to accept the delivery from the courier or
- by not collecting the package from the Inpost Parcel Locker or
- by submitting a written declaration of withdrawal from the contract within 14 days from the date of taking possession of the purchased goods.
- To withdraw from the contract, the Consumer must inform the Seller in writing of their decision to withdraw from the contract through a clear statement sent to the Seller within 14 days from the date of taking possession of the purchased goods.
- The withdrawal statement can be sent to the Seller:
- via Polish Post, courier company to the address: Andrzej Ochojski Wydawnictwo ROZMOWY, ul. Gliwicka 3/3, 44-200 Rybnik or
- by email to: biuro@artantonio.com.
- The Consumer may use the template withdrawal form available athttps://artantonio/shipping but it is not mandatory.
- Upon withdrawing from the contract, the Consumer is obliged to return the product to the Seller without delay, but no later than 14 days from the day they withdrew from the contract, unless otherwise agreed in writing with the Seller. Sending the product back before the deadline is sufficient to meet this requirement.
- The Consumer bears the direct costs of returning the product.
- The product should be returned to the address: Andrzej Ochojski Wydawnictwo ROZMOWY, ul. Gliwicka 3/3, 44-200 Rybnik, unless the parties have agreed otherwise in writing.
- In the event of withdrawal from the contract, the Seller will refund the Consumer the payments received from the Consumer, along with the cost of delivering the product (if the cost was borne by the Consumer) without delay, and in any case no later than 14 days from the day the Seller was informed of the exercise of the right to withdraw from the contract. The refund will be made using the same payment methods that the Consumer used in the original transaction, unless the Consumer has agreed in writing to another solution. In any case, the Consumer will not incur costs for the refund.
- The Seller may withhold the refund of the payments received from the Consumer until the product is received back.
- The Consumer is responsible for the decrease in the value of the product resulting from use of the product in a manner that exceeds what is necessary to ascertain the nature, characteristics, and functioning of the product, as well as for any damages. The Seller has the right to reduce the amount of the refund by the amount of the decrease in the value of the product.
8. Liability for defects
- The Seller is obliged to deliver a product free from defects to the Buyer.
- The Buyer has been informed that the product is handmade, so no characteristic resulting from such a method of production is considered a defect compared to production in another way.
- The Seller is liable to the Buyer if the sold product has a physical or legal defect (warranty for defects).
- If the sold product has a defect, the Buyer may:
- demand a replacement of the product for one free from defects,
- demand the removal of the defect,
- submit a statement to reduce the price,
- submit a statement to withdraw from the contract.
- If the Buyer discovers a defect in the product, they should inform the Seller about it, specifying their claim related to the discovered defect or submitting a statement of appropriate content.
- The Buyer may use the complaint form available athttps://artantonio/shipping but it is not mandatory.
- The Buyer can contact the Seller both by traditional mail and by email.
- The Seller will respond to the complaint submitted by the Buyer within 14 days from the day the complaint is delivered to them using the same means of communication by which the complaint was submitted.
- Details regarding the Seller's warranty for defects are regulated by the provisions of the Civil Code (art. 556 – 576).
9. Personal data and cookies

10. Out-of-court methods of handling complaints and pursuing claims
- The Seller agrees to submit any disputes arising from the sale of goods to mediation proceedings. Details will be determined by the parties in conflict.
- The Consumer has the option to use out-of-court methods of handling complaints and pursuing claims. Among others, the Consumer has the option to:

- turn to a permanent consumer arbitration court with a request to resolve the dispute arising from the sales contract,
- to contact the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for an amicable resolution of the dispute between the Buyer and the Seller,
- to seek assistance from the district (municipal) consumer rights advocate or a social organization whose statutory tasks include consumer protection.

- Consumers may also use the ODR platform, which is available athttp://ec.europa.eu/consumers/odr. The platform is used for resolving disputes between consumers and entrepreneurs seeking out-of-court resolution of disputes arising from contractual obligations resulting from online sales agreements or service agreements.
11. Final provisions
- The Seller reserves the right to introduce and withdraw offers, promotions, and to change product prices in the Store without prejudice to the rights acquired by the Buyer, including in particular the terms of contracts concluded before the change.
- The Seller reserves the right to make changes to the Regulations. For contracts concluded before the change of the Regulations, the Regulations in force on the date of the conclusion of the contract shall apply.
- Buyers who have an account in the Store will be notified by email to the address assigned to the account of any changes to the Regulations. In case of non-acceptance of the content of the new Regulations, the Buyer has the right to terminate the account management agreement at any time by deleting the account or submitting a relevant statement to the Seller, in any form, regarding the termination of the account management agreement.
- The Regulations come into force at the moment of their publication on the Service.
In matters not regulated by the regulations, the provisions of the Civil Code and relevant Polish law statutes, as well as European Union law, particularly the GDPR (Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) shall apply.
